Rental Policies and Agreement
This agreement constitutes a contract between the Guest(s) and PCRS Management Inc., d.b.a. Paradise Hills, Resort and Spa (PHRS).
Paradise Hills Resort & Spa serves as the agent and representative of all owners of rental cabins in our rental program, and is acting at all times, in and for the best interests of the owners.
OCCUPANCY - Guest(s) understands that Paradise Hills Resort & Spa will only accept reservations from responsible adults above 21 years of age. ABSOLUTELY NO EXCEPTIONS. Guest who initiates rental will remain responsible for all guests(s) or Licensee of Guest(s) during occupancy of subject property.
Maximum occupancy is stated in all accommodation descriptions. Any child 4 years old and above is considered an occupant & must be included in the occupancy total. If you are found to exceed the maximum occupancy of your cabin, it will be determined a breach of contract and will result in immediate eviction with NO REFUNDS.
ADDITIONAL GUESTS - Additional guests, over the age of 3, must be pre-approved by Paradise Hills Resort & Spa and there will be a charge of $10 per person per night. There is no charge for children under the age of 4.
CLEANING FEES – Our nominal cleaning fee rates will vary according to the size of the cabin. It is of the upmost importance to us that upon arrival you find your cabin in top-notch shape from the furniture, floors, bathrooms, bedding, dishes and linens to the hot tub.
CHECK-IN TIME is 3 PM at Paradise Hills Resort & Spa, 366 Paradise Road, Blairsville, GA 30512. Keys are not available until the rental cabin is ready for occupancy. Paradise Hills Resort & Spa will use all reasonable efforts to have the cabin ready for guest occupancy at check-in time, but Paradise Hills Resort & Spa cannot guarantee the exact time of occupancy. Please call our office in advance if you are arriving after 6 PM so key arrangements can be made. Late Check- in’s require full payment before arrival.
CHECK-OUT TIME is prior to 11 AM. LATE CHECK-OUT (2 PM) MAY BE AVAILABLE FOR A FEE OF $50 AND MUST BE PRE-ARRANGED. Please be prompt as to allow us to have adequate time to prepare the cabin for the next guests and return all keys to avoid additional charges. Guests who do not check out prior to 11 AM and do not have prearranged late check-out will be charged a fee of $25 per hour late fee (rounded up to nearest hour); minimum of 1 hour.
RESERVATION REQUIREMENTS - 50% of the reservation total is due at the time of booking in order to confirm your reservation. A signed RESERVATION AGREEMENT is required to secure a reservation; which can be completed electronically online. If booking on-line, you will need to accept these terms & conditions when prompted to do so. PHRS accepts MasterCard, Visa, and Bank checks drawn on U.S. Banks. (If securing with a check, it must be received by PHRS within 3 days after booking has been made or the reservation will be cancelled). Balance of rental fee is due the day of arrival with cash, certified funds, traveler’s checks, MasterCard, or Visa. WE DO NOT ACCEPT CHECKS (EXCEPT TRAVELER’S) AT CHECK-IN.
TAXES AND FEES - For pets, a flat-rate pet fee of $25 plus tax is charged. An end-of-stay cleaning fee is required for all rentals. Cleaning fees vary by cabin, so check the individual cabin listing for the exact cleaning fee amount. Applicable taxes are 7% state tax and 5% county tax on all rentals.
CANCELLATION - ALL CANCELLATIONS MUST BE MADE IN WRITING or E-Mail firstname.lastname@example.org (you must receive an acknowledgement from us receiving your email) or Certified Mail. A $25 handling fee is assessed for any cancellations or cabin/date changes within 14 days – 8 days of the reservation arrival date.
CANCELLATION POLICY for individual cabins…states that up to 14 days (2 weeks) from your reservation date, we will refund your one night deposit minus a $25 handling fee. Less than 14 days, the deposit becomes non-refundable… Seven (7) or less days before your reservation, you will be responsible for the full reservation amount. There are no refunds for early departure. There are no refunds for gift certificates.
CANCELLATION POLICY for multiple cabins (6 or more) reserved for 1 event (Group Rate)… The initial deposit is non-refundable. 14 days (2 weeks) or less before your reservation, you will be responsible for the full reservation amount. There are no refunds for early departure.
RESCHEDULING POLICY for individual cabins…states that up to 14 days (2 weeks) from your reservation date, we will reschedule a reservation, based on availability, for no charge. Within the 14 days from arrival AND more than 7 days, we will reschedule a reservation for a $25 handling fee and the deposit does remain in “non-refundable status”. 7 or less days, we cannot reschedule a reservation. Please call for options.
NO-SHOW POLICY - The total amount of the reservation will be charged the day of arrival along with a $30 administration fee.
CONFIRMATION - Confirmation of the reservation will be emailed to Guest(s) immediately upon booking your reservation on-line. Please read the confirmation for accuracy of dates, mailing address, number of adults and/or children and accommodations. Report any errors to PHRS, as soon as possible. Pay close attention to the number of persons on the confirmation. Occupancy is limited to REGISTERED GUESTS ONLY. Absolutely no overnight visitors are allowed without prior arrangements made in advance in writing.
KEYS - All keys must be returned to the PHRS office upon Check-out, left in key drop at lodge or left in lockbox for offsite cabins. Our rental cabins are privately owned and Guests are responsible for lost keys. The property must be re-keyed in the event the keys are lost, misplaced or not returned and you will be responsible for the cost of this procedure.
SATELLITE TELEVISION - All cabins are privately owned and have different subscription packages for satellite. Paradise Hills does not guarantee any programs or events.
TELEPHONE – Most cabins are not equipped with a telephone. Cellular reception cannot be guarantee at your cabin. Service providers Verizon Wireless and Sprint dominate our area.
FIRE PLACES - All PHRS cabins have wood burning or gas log fireplaces. WOOD BURNING fireplaces are seasonal and PHRS will provide an initial bundle of wood, free of charge, for interior fireplaces, from October 1 through April 1st. Additional bundles are available for sale at PHRS. Firewood is not provided for fire pits but local gas stations and grocery stores sell small bundles of wood. Please note, if you use an outdoor fire pit, you are responsible if any “wild fires” start and could be subject to fines or response charges by the Department of Forestry. No fire will be left unattended and no other item (charcoal, accelerants, etc.) will be burned in wood log fireplaces. Guests agree to pay a clean out fee of $50 if any items other than wood logs are burned in fireplace. GAS LOG fireplaces – no other items (hot dogs, marshmallows, wood, etc.) besides gas logs will be burned in gas log fireplaces. Guests will not disturb, adjust, move, cook-over or otherwise damage gas logs in fireplace box. Guests failing to comply will result in a $250 damage fee charge.
BARBECUE GRILLS - Charcoal is NOT provided for rental cabins with charcoal grills. Propane IS provided for gas grills. Each rental cabin has a grill; please refer to the cabin description of the cabin you are interested in. Improper use of any grills will result in $50 damage fee charge, not to exclude full replacement of grill.
NO SMOKING - All cabins are NON-SMOKING and this policy is strictly enforced. Smoking is allowed outside on the porches and decks. Please do not dispose of the cigarette butts in the yard or surrounding grounds. If cigarette butts are found on the grounds, an additional cleaning charge will be incurred.
ALCOHOLIC BEVERAGE - By Georgia Law, no drinking of alcoholic beverages by persons under the legal age of 21 is allowed. NO HOUSE PARTIES ALLOWED. Violation will be cause for immediate eviction with loss of all rent monies paid.
PETS FRIENDLY CABINS- Many cabins allow dogs so please contact us prior to reserving a cabin if you would like to bring your pet with you. The flat-rate pet fee charge is $25 (up to 2 dogs). Pets are to be housed in a crate inside of cabin when Guests are away from cabin. Guests are completely responsible and liable for any damage, caused by their pet(s), to the cabin and its premises during their stay. If you have a pet and it is not listed on the reservation agreement, your immediate eviction and loss of all rents and security deposit will result. Prior permission must be granted. Pets are not allowed on furniture or bedding.
CABIN FURNISHINGS & EQUIPMENT - All cabins are privately owned with furnishings and equipment provided by the cabin owner. PHRS cannot make any changes to this. Moving of furniture is prohibited. If you require special appliances or equipment, please bring them with you. Decor, style, color and themes will vary between rental cabins. Furnishings are subject to change without notice. – All furnishings/furniture in the cabin are in place as the owners wish them and Guest(s) agrees to pay not less than $100 if furniture is rearranged in such a manner that results in cleaning services being delayed.
DEER – COYOTE – BEAR – INSECTS - Deer, Coyote, Bear, Turkey, Possum, Raccoons, Ladybugs, Carpenter Bees, Wasps, Scorpions, Ticks, Ants, Chiggers, etc. may be encountered in the mountains. There is no refund for the presence of typical North Georgia mountain creatures.
LINENS - All cabins are supplied with bed linens, towels, blankets and pillows. These items are not changed during your stay. PHRS provides your initial supply (1 to 2 days) of paper products, soaps, and trash bags etc. for your convenience.
CABIN DESCRIPTIONS AND RATES - Information regarding the individual rental cabin is believed to be accurate but cannot be guaranteed. We have made every effort to ensure that all the information on the PHRS website www.paradisehillsresort.com is current and accurate. The possibility of errors and omissions still exists. We will be happy to confirm all the information or answer any of your questions prior to booking your reservation by calling us toll-free at 877-745-7483. Rates, furnishings, fees and taxes are subject to change without notice. Rates for weekly stays are found on our website at www.paradisehillsresort.com.com. Rates do not include end-of-stay cleaning fee, pet fees, extra person fees, or rental tax. Most of our properties can be rented for a two-night minimum stay. Minimum night requirements: Two night minimum for non-holiday, Three night minimum for holiday weekends, Four night minimum for Thanksgiving & Christmas.
OWNER’S CLOSET - Rental Cabins may have a locked private Owner’s Closet that is not part of the Guests rental and Guests agree not to disturb the same.
HOT TUB - Hot tubs are drained, cleaned, refilled & water is balanced prior to your arrival. There is a $35 convenience charge if you wish to have an additional cleaning of the Hot Tub during your stay. Instructions are provided at the cabin for proper operation and easy maintenance during your stay. Please observe the rules posted for each hot tub & follow them. Use at your own risk. Do not use hot tub if you are or suspect you are pregnant. Children under the age of 12 must have adult supervision. No bubble bath, salts, or soaps of any kind allowed in the hot tub. Please do not sit on the hot tub cover or put your knees on the control panel. Guest(s) should shower before and after each hot tub use. It is also highly recommended that swim suits be washed with clean water after each use. This is for personal hygiene and sanitation purposes. Following these instructions limits the likelihood of bacteria build-up between uses. Drinking containers i.e. glasses, bottles, cans; smoking and pets are strictly prohibited. If evidence is discovered, a fine of $100.00 will automatically be charged to responsible Guest(s) of record. All hot tubs go through (2 to 4) automatic filtering/cleaning cycles that last up to (3) hours. Hot tub and Jets will not turn off during this cycle.
TRASH AND/OR LITTER - All trash must be bagged and placed in trash cans or trash bin provided on property. Failure to bag trash or placing loose trash in trash cans/bin will cause an additional Housekeeping fee/fine of $50 automatically charged to the responsible Guest(s) credit card of record. Should the trash cans be full upon arrival, please contact PHRS. LITTER: If litter (trash reminisce, cigarette butts, cans / bottles, etc…) are discovered post occupancy an additional Housekeeping fee of $50 will be assessed and charged to the guest credit card of record.
CHECK-OUT PROCEDURES - We ask that you please comply with the following items prior to check-out: Property should be left in the same condition it was when you arrived. All litter, cigarette butts and pet waste should be picked up from the yard and placed into a trash bag. All trash put in the outside garbage cans. Please lock all windows and doors, set A/C to 78 or heat on 55 degrees depending on the season. We ask that you please wash, dry and put away all the dishes, pots, pans, and kitchen utensils (do not leave in dishwasher).
REPAIRS – SERVICE CALLS - PHRS cannot guarantee against mechanical failure of heating, air conditioning, Hot Tubs, TV’s, Satellite Receivers, DVD players, Wi-FI modems or other appliances. There should be no expectations of REFUND OR REBATES. Please report any equipment that is not operating properly. PHRS will make every effort to resolve the problem as quickly as possible. Should a repair person make a call to a cabin and find the equipment in working order and the problem was due to Guest(s) oversight or neglect, the charge for the service will be the Guest(s) responsibility. All maintenance repairs must be reported to PHRS between 9 AM and 6 PM. Guest(s) understand and agree that PHRS or its repair people might need access to the cabin for the purpose of making the repair.
REFUNDS - or rate adjustments are not made for any inconvenience due to construction noise, road repairs, mechanical failures, early departures, delayed arrivals or reducing the number of nights reserved with less than 15 days notice. No refunds due to inclement weather but we will reschedule your visit at no charge.
TERMINATIONS BY OWNER/SUBSTITUTIONS - PHRS strives to comply with your reservation requests, however, due to uncontrollable circumstances beyond our control, changes in ownership, properties being removed from the rental program, mechanical problems, etc. We cannot absolutely guarantee a specific rental cabin. PHRS reserves the right to change your cabin without notice or liability should the cabin become unavailable. Neither the owner nor PHRS shall be liable for events beyond their control which may interfere with your visit. This may include but not limited to Acts of God, acts of Governmental agencies, fire, war, inclement weather and construction noise. No rebate or refund will be offered in these circumstances. We will try to offer a comparable cabin at the same rate satisfactory to you or you can receive a complete refund of your reservation deposit. PHRS will attempt to give you as much notice as possible so other arrangements can be made.
HOUSE PARTIES ARE NOT ALLOWED - Rental guests understand that PHRS will accept responsible adults above the age of 21 years old only. Guest(s) agree that no more than the number of persons listed on the reservation agreement shall occupy the premise. House parties will not be tolerated or if the cabin is occupied by more than the number of persons stated, the result will be a loss of total rent, security deposit and/or additional charge to your credit card. Guests shall not disturb or offend any neighbors, discharge firearms or use fireworks of any kind in accordance with State of Georgia and Union County laws. We reserve the right to ID any guest for proof of legal age. THERE IS a 10 p.m. quiet time.
Even for groups reserving multiple cabins, HOUSE PARTIES ARE NOT ALLOWED. Guests agree that no informal or formal parties will occur at ANY reserved cabin(s). If a party occurs, the result will be a $300 cleaning fee, any/all charges for any damages incurred and the guests will be asked to leave. There will be NO REFUNDS.
LOST & FOUND - Any personal items left in the rental cabin can be mailed to you at your request for a fee of $20.00 plus postage. We will charge your credit card and an invoice will be included in your package. Any items left over 7 days will be donated to charity.
HOLD HARMLESS & INDEMNIFICATION - Guest(s) agree to hold harmless & indemnify the Owner & PHRS for any liabilities, damage, theft, expense or cost arising from or related to any litigation or claim which may arise out of or in connection with Guest(s) occupancy & use of the rental property. This is including but not limited to any liability or claim for personal injury or theft or damage of personal property that is made, incurred or sustained by Guest(s). The terms “PHRS” & “Owner” are used in this agreement shall include their successors, assigns, heirs, employees, agents and representatives where the context requires or permits. The terms “Guest(s)” and Licensee of Guest(s), successors, assigns, heirs, guests, invitees, representatives and other persons who happen to be on the rental property during Guest(s) occupancy (without regard to whether such persons have authority under this agreement to be at the rental property), where the context permits or requires.
PHRS reserves the right to refuse service to anyone. All rental cabins are leased without regard to race, color, religion, sex, national origin or handicap. Responsible Guest must be over the age of 25 years.
DENYING PAYMENT, ADDITIOAL FINES OR FEES - Should PHRS have to obtain legal advice or counsel for any matter arising from any payment discrepancy involving a Guest(s) or payment vendor such as a credit card company, PHRS’s legal counsel Larry Sorgen, PA will seek rightful collection or payment for PCRS on behalf of Owner. If disputes are transferred from PCRS’s management to a collection agency, responsible Guest(s) of record will be liable for all incurred charges proved to be their responsibility in a court of law.
DISPUTES – This Agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia, and shall be treated as though it were executed in Union County, Georgia. Any action whatsoever in relation to this Agreement shall be instituted and prosecuted only in the Union County Superior Court, Georgia. Guest(s) specifically consents to such jurisdiction & to extraterritorial service of process.
CREDIT CARD - I, the Guest, attest I am over the age of 21 years old & I am providing my credit card number as a guarantee. I agree to pay all rent, accept all terms of this reservation agreement and accept all liability for any damage, including pet damage, beyond normal wear and tear during the term of my lease with PHRS. If I fail to do so, I understand any fines or damage will be charged to my credit card and all credit card sales are final.

By booking this reservation, I attest I am over the age of 21 years, I have read and fully agree to all the above policies (5 pages) and to hold harmless from any responsibility or liability, PHRS, cabin owners and their representatives resulting from any loss, damage or personal injury incurred by any Guest on the rental cabin premise.
